Terms of Service
DRAFT: these terms are a working draft pending owner and legal review. Bracketed items are placeholders.
1. About these terms
These Terms of Service ("Terms") govern your use of the website at hypervisor.gg and the Hypervisor trading interface (together, the "Interface"), operated by [OPERATOR LEGAL NAME] ("we", "us"). By accessing or using the Interface you agree to these Terms. If you do not agree, do not use the Interface.
2. What Hypervisor is
Hypervisor is a software interface that displays public market data from the Hyperliquid L1 and HyperEVM networks and helps you prepare orders and transactions. The networks, their order books and the third-party protocols the Interface connects to (for example lending and liquidity protocols on HyperEVM) are operated by others. We do not operate them and we are not a party to your transactions on them.
3. Non-custodial: you control your wallet
- Hypervisor never holds, controls or has access to your funds, private keys or seed phrase.
- Every order, transfer or transaction is created in your browser and only takes effect when you sign it with your own wallet. Signed actions are sent directly to the relevant network and generally cannot be reversed.
- If you authorise an agent (API) wallet for faster trading, its key is created and stored in your browser. You are responsible for securing your device and for revoking authorisations you no longer want.
- We cannot recover lost keys, cancel confirmed transactions or refund losses.
4. No investment advice
Nothing on the Interface is financial, investment, legal or tax advice, or a recommendation to buy, sell or hold any asset. Data shown (prices, order books, funding rates, leaderboards, labels, analytics) may be delayed, incomplete or wrong. Make your own decisions and seek independent advice where appropriate.
5. Risks
You understand and accept that, among other risks:
- Trading perpetual futures, leveraged and spot digital assets, and prediction markets can lose some or all of your funds quickly. Leveraged positions can be liquidated.
- Blockchains, smart contracts, bridges, oracles and third-party protocols can fail, be exploited, halt or change without notice.
- Network congestion, outages, rate limits or Interface errors can delay or prevent your orders.
- Digital-asset prices are volatile and regulation may change in ways that affect you.
6. Eligibility and geographic restrictions
You must be of legal age and able to enter a binding agreement. You may not use the Interface if you are a resident of, located in, or incorporated in [RESTRICTED JURISDICTIONS — OWNER/COUNSEL TO SPECIFY], or if you are subject to sanctions administered by [SANCTIONS AUTHORITIES — OWNER/COUNSEL TO SPECIFY]. You must not use a VPN or other means to get around these restrictions. We may restrict access from any location at any time.
7. Acceptable use
You agree not to use the Interface for unlawful activity, market manipulation, money laundering, to attack or overload the Interface or its infrastructure, or to infringe anyone's rights.
8. Fees
Network and protocol fees are set by those networks and protocols. [BUILDER / INTERFACE FEE DISCLOSURE — OWNER TO SPECIFY, including when a fee applies and how it is shown before you sign.]
9. Third-party services
The Interface links to and integrates with third-party networks, protocols, wallets and data providers. We do not control and are not responsible for them; your use of them is governed by their own terms.
10. Disclaimers and limitation of liability
The Interface is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential losses, or for any loss of funds, profits or data arising from your use of the Interface or of any network or protocol it connects to. [LIABILITY CAP AND CARVE-OUTS — COUNSEL TO SPECIFY.]
11. Changes and termination
We may change, suspend or discontinue the Interface, or update these Terms, at any time. The "Last updated" date shows the current version. Continued use after a change means you accept the updated Terms.
12. Governing law
[GOVERNING LAW AND DISPUTE RESOLUTION — COUNSEL TO SPECIFY.]
